Citing Recent Supreme Court Ruling, NC Judges Dismiss Combined 13 Moral Monday Cases on Constitutional Grounds

DURHAM, NC - Two judges have now dismissed 13 cases against Moral Monday arrestees on the Constitutional grounds that Police Chief Jeff Weaver's order to leave the General Assembly building was not "narrowly tailored," that the Legislative rules were vague and overbroad and that the Moral Monday arrestees' constitutionally protected right to assemble, speak and redress their grievances were violated by these arrests on June 24 and July 15, 2013. These rights were protected by the First Amendment to the United States Constitution and Article I, Sections 12 and 14 of the North Carolina constitution.

McCrory claimed he would veto any budget that cut teacher assistant funding, yet school districts are already reporting teacher assistant funding shortfalls that may cost them hundreds of positions.
For many veteran teachers, raises will be less than 2% and this budget does almost nothing to improve our ranking of 46th in the nation for per pupil standing. Textbook funding is still far below previous years, so chances are your kids will have outdated textbooks and might not even be able to bring them home!

Even as North Carolina General Assembly Locks Its Doors on Moral Monday,
11 Protesters Arrested Yesterday for Sit In at Gov. McCrory's Office
NC NAACP and the Forward Together Moral Movement Call on Governor and Legislative Allies to Repent, Repeal and Restore
RALEIGH, NC - People from all across North Carolina rallied at the General Assembly yesterday for the latest Moral Monday protest of harmful legislation passed last year by Gov. Pat McCrory and the legislature. Despite the legislature locking the doors in an attempt to keep petitioners out, a group of 11 people - everyday North Carolinians impacted by a lack of heath care access and environmentally polluting policies - staged a sit-in at the governor's office.
The 'McCrory 11' were arrested and charged with second-degree trespassing around 7 pm Monday after refusing to leave until McCrory agreed to meet with them about the impact of his policies on the health of the land and people of North Carolina.
Yesterday's Moral Monday went on despite the Senate's decision to hold a midnight session on Friday, allowing them to avoid returning to the General Assembly until Wednesday and miss the demonstration. The group changed plans by instead focusing on the governor, to whom they also delivered a letter calling on him to repeal the extreme policies; repent for the impact they are currently having on North Carolina's poor and working class and to restore a legislative commitment to governing for the betterment of the state.
"Speaker Tillis and Senate Leader Berger knew we were coming, and they locked the doors to the General Assembly building to prevent us from coming in," said Rev. Dr. William J. Barber, II, president of the North Carolina NAACP. "But we would not be moved from our purpose - calling upon them and Gov. McCrory to repeal these disastrous policies that are hurting the very people God loves - the sick, the poor, the women and children, the elderly, the least of these. Our eleven moral witnesses would not be moved from their attempts to petition the governor directly. If we expand Medicaid in our state, we would save 2,800 lives. If we cleaned up coal ash and blocked fracking in our state, we would save lives. That is what this moral witness today was about. To our governor and our state lawmakers, we say: if you are going to engage in premeditated political ideology that hurts the least of these, then we will give no quarter. These are matters of life and death, and the blood will be on their hands."
Other speakers illuminated the damage inflicted by various policies, including a new bill passed last week in the House and Senate to end North Carolina's moratorium on fracking, along with the current denial of health care access to 500,000 North Carolinians because of the refusal to expand Medicaid.
"These legislators are setting us up for a perfect storm of disasters while they simultaneously knock down our protections," said the NC Environmental Justice Network's John Wagner, of the bill to rapidly expand the polluting business of shale gas mining, or fracking, along with other environmentally damaging policies. "Our legislators weakened local landfill laws and regulations last year, right before they planned to flood our communities with toxic fracking landfills. We are facing terribly hard times imposed by cruel and blatantly immoral legislation, but together - and it has to be together - we have to fight."
"Refusing to expand Medicaid has forced several hospitals in North Carolina onto life support," said Nicole Dozier, assistant project director with the Health Access Project at the NC Justice Center. "Hospitals in expansion states have already seen big increases in the numbers of insured patients they see and big decreases in their shares of uninsured patients... I'm here today with a caution to the governor and the legislature: In your race to win power, don't lose your soul. Expand Medicaid now."
"Governor McCrory, Speaker Tillis and Senator Berger's refusal to accept federal dollars to pay for the care of the uninsured is not rational, is fiscally irresponsible and lacks moral standing," said former Congresswoman Eva Clayton, who made the economic case for Medicaid expansion. "This is especially difficult to understand given North Carolina's current budget shortfall."
Speakers also lifted up the devastation caused by the Dan River coal ash spill earlier this year, in which Duke Energy spilled tons of toxic coal ash into a river in Eden, NC - disproportionately affecting the poor and communities of color.
"The quality of the air, water and land - and most importantly, the quality of life for North Carolina's people - is in jeopardy," said Connie Leeper, lead organizer for the environmental nonprofit NC WARN, who also called on legislators to hold Duke Energy accountable with a substantial plan for cleaning up coal ash.
Rev. Dr. T. Anthony Spearman of Clinton Tabernacle AME Zion Church and Rev. Joe Hoffman of Asheville's First Congregational United Church of Christ closed the rally by speaking to the moral mandate that motivates the Forward Together Movement to continue its campaign against these extreme policies in our state.
"We are not the kind of people that shrink back when times get rough," Dr. Spearman told the assembled. "Because of the moral conviction you bring, you are presently the best thing going for the State of North Carolina. I heard somewhere recently that those who appear to be in power will never have ALL the power. There will always be a residual power, an unconsumed, unused, surplus power in community enabling us to shift the center of political gravity and further bend the arc of the moral universe toward justice."
In addition to delivering a letter to Gov. McCrory calling on him to "Repeal, Repent and Restore," protesters delivered similar letters to Speaker Tillis and Senator Berger yesterday, leaving them wedged under and around the General Assembly's locked doors. The Forward Together Moral Movement vowed to return the General Assembly every week until their demands are met.

At the Forward Together Moral Movement People's Lobby & Advocacy Day, grassroots volunteer lobbyists from across North Carolina will visit state legislators to advocate for returning public policy to the moral center - particularly for the expansion of Medicaid, the restoration of the Earned Income Tax Credit, the extension of unemployment benefits, increased support for teachers and public schools, stronger environmental regulation around coal ash and a fair tax code that does not give huge windfalls to the wealthy and corporations, only to overburden the working poor.
Prior to the lobbying session, movement supporters will attend a policy briefing by scholars and experts so as to better understand the tremendous benefits North Carolinians could gain if state lawmakers were to repeal and reverse these extreme policies.

"Last Monday, we entered the General Assembly with tape over our mouths to dramatize Speaker Thom Tillis's and Senate Leader Phil Berger's tyrannical attempt to silence public petitions in the People's House," said Rev. Dr. William J. Barber, II, president of the NC NAACP. "We said it then, and we will say it again, that was the last time we will be silent when our brothers and sisters are suffering under these extreme policies and laws. This Tuesday, we will go into the People's House ready to make our voices heard on behalf of thousands of North Carolinians. By visiting each and every North Carolina legislator in person, we hope to remind them that their political choices are more than just policy debates - they are hurting real people."
At the People's Lobby & Advocacy Day, volunteer lobbyists will gather at 12:30 pm on Halifax Mall behind the General Assembly building to listen to a policy briefing from scholars and to receive advocacy instructions. The assembled will break into smaller lobbying teams around 2:30 pm and head into the General Assembly to visit the offices of our state legislators to advocate for repeal.
Also at 1:00 pm, members of the clergy will hold a program for lawmakers entitled: "Moral Foundations for Public Policy: Bible and Prayer Study" in the General Assembly for those interested in discussing the social mandates instrumental to our faith traditions. Information on the specific room for the Bible and Prayer Study will be forthcoming.

DURHAM, NC - In the wake of the flood of extremist laws passed last session, the North Carolina NAACP and Forward Together Moral Movement return to Raleigh today for Moral Monday. This afternoon at 5 pm, we will petition our lawmakers to repent from their immoral actions last session, to repeal these laws that are hurting our state's most vulnerable and to restore our confidence in their ability to govern for the good of the whole.
"We're back because what was on paper as policy last year is in fact now causing pain and problems in the lives of real people," said Rev. Dr. William J. Barber, II, president of the North Carolina NAACP and architect of the Forward Together Moral Movement. "Thom Tillis and Gov. McCrory have presided over the most extreme state government that NC has seen in recent years. This General Assembly denied the expansion of Medicaid, costing 500,000 people life-saving care. This General Assembly refused to accept money for federal unemployment benefits when North Carolina families were struggling to make ends meet through the Great Recession. They passed the worst voter suppression law we have seen since Jim Crow. They slashed funding from our public schools and launched an attack on our teachers. They passed a tax law that increases the burden on the working poor while giving huge windfalls to the wealthy and corporations. In addition to their political tragedy, these extremist lawmakers are now adding to their political tyranny by trying to stifle the protests of the people."
Gov. Pat McCrory claims our state is in the middle of a "Carolina Comeback." At Moral Monday, we will expose the reality beneath his rhetoric.
Before the rally from 4:15 to 4:30 pm, the North Carolina NAACP and the Forward Together Moral Movement also welcomes the media to a press conference where we will explain why Moral Mondays had to return to Raleigh. Starting at 5 pm on the Bicentennial Mall outside the General Assembly, moral leaders, everyday North Carolinians impacted by these laws and advocates will address the following issues: Medicaid expansion, health care access and women's health; unemployment, labor rights and tax fairness; public education; corporate greed and environmental regulation; and voting rights. After their testimonies, Dr. Barber will speak to the assembled.
Around 6 pm, members of the clergy will take the stage to invite all people, including state legislators committed to repealing these extreme laws that are hurting our most vulnerable, to join us in a symbolic love feast. As a sign of our moral conviction that we have more than enough for everyone's need (even if not for everyone's greed), we will break bread together in the People's House.
After the love feast, the NC NAACP, the Forward Together Moral Movement and its supporters will walk through the General Assembly building, two by two, to dramatize this shameful attempt by Speaker Thom Tillis and his extremist cohorts to silence the legitimate discontent of North Carolinians. After the action, we will announce our plans for the People's Lobby Day, scheduled to take place at the General Assembly on Tuesday, May 27.
Dr. Barber, coalition partners and other Moral Monday speakers will be available for media interviews outside the General Assembly building after the action concludes. Tomorrow, the North Carolina NAACP and the Forward Together Moral Movement will host a press call on the Moral Monday rally and action at 11 am.

The North Carolina NAACP and the Forward Together Movement Joined the Alabama-Based Saving OurSelves Coalition Today in Raleigh Yesterday to Call for Federal Voter Protections and to Celebrate a Common Commitment to Voting Rights
RALEIGH - The North Carolina NAACP and the Forward Together Moral Movement joined together with the Alabama-based Saving OurSelves Coalition to hold a rally and press conference yesterday in Raleigh calling upon Congress to restore the Voting Rights Act of 1965 to its full strength.
The Forward Together Movement welcomed the SOS Coalition yesterday afternoon as its Caravan for Democracy makes its way from Selma, Ala. to Washington DC, leaving 49 years almost to the day after civil rights leaders were beaten for daring to organize for voting rights in the Jim Crow South. Many of the assembled carried signs that memorialized the efforts and sacrifices made at Bloody Sunday in March 1965, sacrifices that spurred Congress to act on the mass disenfranchisement of African Americans by passing the Voting Rights Act later that summer.

More than 80,000 North Carolinians Rallied Outside State Capitol, Set Justice-Driven Agenda Saturday at Moral March on Raleigh
Diverse Assembly Kicked Off a Year of Voter Empowerment, Nonviolent Direct Action and Litigation
RALEIGH - Protesting against the regressive laws passed by extremists in the General Assembly last year, upwards of 80,000 people marched on the state capitol Saturday morning, according to the march's logistics and planning experts. Called the Moral March on Raleigh, the event's multiracial, intergenerational crowd also advanced an agenda for moral and constitutional public policy.

RALEIGH - On Monday, September 16th, 2013 the NC NAACP Youth & College Division along with other youth organizations including NC Student Power Union, the Youth Organizing Institute, Common Cause and NC Vote Defenders will come together with adult allies in the Forward Together Movement to demand that NC Governor Pat McCrory stop the attacks on student voting rights and public education.
They will meet at First Baptist Church, 101 S. Wilmington St. in downtown Raleigh, at 4:30 PM and walk around the Governor's Mansion at 5:30 PM following a rally led by young people.
"Young people have always been an active and important part of the Forward Together Movement," said Dr. Barber. "As school begins across the state, they will continue to organize and build this movement in response to the immoral and unconstitutional attacks on student voting rights and public education. This is a Movement, not a moment!"

While Grieving the Unconstitutional Laws at the General Assembly
DURHAM - The purpose of the Moral Monday Movement has always been to shine the clear light of justice on the extreme regressive policies of the Pope-Koch financed group that took over the NC Republican Party a few years ago. This regressive group secretly engineered a race based gerrymandering scheme that was not subject to a veto by Gov. Perdue in 2010. This most race based redistricting plan since the 19th Century - that stacks, packs and bleaches the African American and minority vote - allowed them to seat a "super-majority" in the People's House on Jones Street, although a majority of the voters voted against them!
The North Carolina NAACP has chalked up eight years of experience fighting the shadowy Pope-Koch forces. We watched them insinuate their mean-spirited policies into the public discourse. While we built a broad progressive coalition of over 150 partners in our Historic Thousands on Jones Street Movement . . . while we helped pass laws that strengthened democracy and fairness in our beloved North Carolina . . . the Pope-Koch forces of bias, and backwardness took over Mr. Lincoln's Grand Old Party and made a U-Turn on Jones Street, promoting and passing an agenda that assaulted moral, human, and constitutional rights of the vast majority of North Carolinians - evidenced by the new voter suppression law, the worst and most vulgar attempt to manipulate elections in this country.
