WASHINGTON, D.C. – On Tuesday Senator Thom Tillis (R-NC) announced that he is co-sponsoring the Forty Hours Is Full Time Act, S.30, to require the Internal Revenue Service (IRS) to define a “full-time employee” as someone who works 40 hours per week, not 30 hours per week as currently defined by the IRS under President Obama’s Affordable Care Act. This 30 hour definition has forced many employers to cut work schedules for many workers in North Carolina in order to keep up with the costs of the President’s health care law.

Upwards of 1,500 North Carolinians Assemble at Legislature to Speak Out against Bills that Hurt Labor, Teachers, Women - and against Lies from Senate Leader Phil Berger
RALEIGH, NC - In a fourth week of peaceful protest at the North Carolina General Assembly during this legislative session, more than 1,500 people from across the state gathered on Monday to challenge the state legislature's extreme agenda and the regressive policies passed last year that have hurt workers. Members of the North Carolina State Conference of the NAACP, labor unions, the fast food workers' organization Raise Up, as well as teachers' and women's groups highlighted the many ways in which budget proposals from state lawmakers are devastating for the poor, working people and most vulnerable residents of the state.
Yesterday, the Forward Together Movement introduced youth organizers who are kicking off Moral Freedom Summer - in which 50 trained organizers will be anchored in 50 communities across North Carolina to register and mobilize voters.
"The main reason for the short session is to pass budgets, but the budgets that we've seen pass here violate the constitutional principle to govern for the good of the whole," said Rev. Dr. William J. Barber II, president of the North Carolina State Conference of the NAACP, during the rally on Halifax Mall. "Each one of them is flawed and extreme because they start from the premise that when you get elected into office as an extremist, your primary role is to please the Tea Party, to please Art Pope and to please those who would take our state backward rather than to serve the population of North Carolina."
Following the rally, the crowd walked inside the General Assembly to petition their legislators, with a group of 20 North Carolinians arrested upon practicing nonviolent civil disobedience. These moral witnesses were cheered on by supporters who filled two floors of the building - singing, clapping and shouting to show their encouragement, as well as to proclaim to lawmakers that their voices will not be silenced. Their voices were further validated with a legal victory last week, in which a Wake County judge ruled that many recent changes to the legislative building rules (designed to prohibit protesters at the General Assembly) were too vague and overly broad to stand up to legal scrutiny, and thus overruled - allowing North Carolinians to freely challenge the status quo in the People's House.
"We are here today because workers are under attack," said MaryBe McMillan, secretary-treasurer of the North Carolina AFL-CIO. "Those who don't have jobs are called lazy. Those who want a living wage are called greedy. And yet our elected officials have doled out fat raises for their friends; they've cut taxes for their corporate donors; and they've even made it so that, unlike wages, campaign contributions can now rise with inflation. ... We are here today to bear witness to the unfairness and immorality of this double standard. But most of all we are here to bear witness to what can be - a state where people take care of each other."
"Elected officials currently in power at the statehouse, I am here to tell you that I suffer and struggle enough as a working mother making $7.25 an hour," said Crystal Price, a Wendy's fast food worker and mother who suffers from cervical cancer - and who falls into the health coverage gap created by North Carolina's refusal to expand Medicaid under the federal Affordable Care Act. "I don't need you passing bills that attack my family and myself, like refusing to expand Medicaid and eliminating the Earned Income Tax Credit on top of everything else I have to go through."
"What they're doing in the North Carolina legislative building is immoral and unconscionable," said J. David Cox, national president of the American Federation of Government Employees (AFGE). "It is unconscionable to deny workers the right to bargain collectively. It is unconscionable to cut unemployment benefits to workers desperately searching for a job. It is immoral to deny Medicaid to half a million North Carolinians."
Alexandra Sirota, executive director of the North Carolina Budget and Tax Center debunked the distortions and misrepresentations that Senate Leader Phil Berger, Speaker Thom Tillis, Gov. Pat McCrory and their allies have proliferated about the Forward Together Moral Movement's agenda, saying that they would cost the state into the billions. When the Budget and Tax Center analyzed the movement's priorities of looking after the sick, poor, workers, teachers and students would in fact be revenue neutral.
"All three budgets we've seen [from North Carolina politicians] are constrained because our policymakers have chosen to cut taxes for the wealthiest in our state and reduce the dollars that are available for building stronger communities in our state," Sirota said. "Our analysis shows that if you take into account what is exactly aligned with the Forward Together Moral Movement priorities, that's a revenue neutral proposal that the state should be considering and that policymakers should be moving forward as they're negotiating their budgets."
"We have come to Raleigh today to say to our legislators that the laws and policies that you have enacted are morally wrong, and they need to be repealed," said Rev. Nelson Johnson, executive director of the Beloved Community Center of Greensboro. "We are a moral movement because we respect the dignity and worth of all of God's children."
Holly Jordan, a teacher for Durham Public Schools, spoke about last week's Moral Monday, during which Senate President Pro Tempore Phil Berger had a discussion with teachers, students and parents. "In their conversation, they made clear that educators will not be pacified by a raise at the expense of social services and teacher assistance," Jordan said. "And several of those educators are back in the building today to tell Senator Berger that conversation that's not followed by action will also not appease us."
"Two-thirds of all Moral Monday arrestees are women," said Janet Colm, CEO of Planned Parenthood of Central North Carolina and a Moral Monday arrestee. "Women know it's impossible to have equal rights without access to healthcare, or to fight poverty and racism without good education and jobs and voting rights. ... Women know the importance of voting, and that two-thirds of voters without ID are women. Women know about the minimum wage. A majority of minimum wage workers in our state are women. And women know we can take back our state."
As the young organizers led the crowd into the General Assembly yesterday to petition state lawmakers to repent, repeal these destructive laws and to restore confidence in their ability to govern for the good of the whole, Dr. Barber emphasized that the Forward Together Moral Movement's work was far from done.
"Not only are we going to fight out here, and fight in the legislative building," said Barber. "We are going to fight in the court, fight in the voting booth and fight everywhere."

Tillis Statement on N.C. Unemployment Rate Continuing to Drop
Raleigh – The following statement is from House Speaker Thom Tillis (R-Mecklenburg) regarding the unemployment rate dropping to 6.2 percent – its lowest point in almost six years:
“It’s no coincidence given our tax, regulatory and unemployment reform that we continue to see a significant drop in unemployment and are able to add jobs for our citizens. I will work on legislation during this short session that will keep improving our economy and placing North Carolinians in good jobs.”
In January 2011, North Carolina’s unemployment rate was at 10.4 percent, higher than the national average. Today’s unemployment rate has dropped by 39 percent to 6.2, falling below the national average. During that time, North Carolina has added more than 200,000 jobs.

- ENDA creates a new special right for someone who claims to be homosexual, bisexual, or transgendered to sue business owners.
- Businesses owned by well-meaning and honest people will be forced to give special rights to men who choose to dress and act like women and women who choose to dress and act like men, regardless of the business owners’ own beliefs or religious faith.
- ENDA will pave the way for frivolous litigation that will make lawyers millions on the backs of America's small businesses.
- ENDA could force small businesses across North Carolina to choose between fighting an expensive and lengthy lawsuit and closing up shop.
- ENDA could be used as the instrument with which all businesses in our country will be cleansed of their Christian beliefs or of their opinions that certain jobs are not suitable for those with “gender identity” or “sexual orientation” disorders.
This law sets a dangerous precedent and poses a direct threat to religious liberty in America and our First Amendment freedoms.

State House and Senate Democrats are calling on Gov. Pat McCrory to save federal unemployment benefits scheduled to end July 1 for 71,000 people in North Carolina.Raleigh, N.C. —
McCrory says that call won't be answered.
The event at the Grandover Resort is part of a retreat for the Renew North Carolina Foundation, a nonprofit that some of McCrory’s supporters formed after his election. Under federal rules, the 501(c)(4) group doesn’t have to reveal its donors, is not constrained by traditional political donation limits, and can spend money to promote “social welfare” causes, including political ones.

I had planned to speak tonight with DNC officials but, as the First Lady was talking about our childrens' future and ensuring that they have everything they need to live happy and productive lives, I simply couldn't stay silent any longer. I'm looking ahead at a generation of young people who could live full, honest, and open lives with the stroke of the President's pen, and I was hoping that the First Lady would share my concern for all of our young people." - GetEQUAL activist Ellen Sturtz, who heckled Michelle Obama yesterday at a Washington fundraiser.

Obama was delivering a speech at a DNC event at a private home in Washington shortly after 6 p.m. when a protester began shouting for the president to sign an executive order to protect gay and lesbian rights, according to pool reports. “ One of the things I don’t do well is this,” Obama reportedly responded to loud applause. She then left the podium and walked toward the heckler, saying she could “listen to me or you can take the mic, but I’m leaving. You all decide. You have one choice.” The protester was later identified as Ellen Sturtz, an activist for the pro-LGBT rights group GetEQUAL. The crowd begged for the first lady to stay and one woman near Sturtz shouted, “You need to go.” Sturtz was reportedly escorted out, identifying herself as a “lesbian looking for federal equality before I die.”

PRICE TO NCGA: DON'T ABANDON THOUSANDS OF NORTH CAROLINIANS WHO HAVE LOST JOBS OR NEED MEDICAL CARE

Washington, D.C. – Today, Rep. David Price (NC-04) urged the Republican leadership of the North Carolina General Assembly to reconsider a fast-moving legislative proposal to deny Medicaid coverage to thousands of North Carolinians. In a letter delivered to legislative leaders over the weekend, Rep. Price (NC-04) also asked the leaders to not to make a proposed change to the state's unemployment insurance program that would effectively deny 80,000 North Carolina residents federally-funded unemployment benefits and therefore pull hundreds of million dollars out of the state's economy.
"Abdicating our commitments to the unemployed, undermining the expansion of health care for working families, this is no way to run a state," Rep. Price said. "Republicans in the General Assembly should reconsider these misguided efforts. Even if Raleigh Republicans are willing to walk away from our commitments to people who have lost jobs through no fault of their own, or people who need access to medical care, preventing nearly $650 million from being spent in North Carolina stores and small businesses is going to hurt everyone."
Earlier today, Republican Governor John Kasich of Ohio announced that his state would expand Medicaid, extending coverage to 366,000 residents. Kasich, an opponent of the health care reform law, has said of the Medicaid expansion, ". . . this is a different issue. This is about people who are at the lower economic end."
In the letter to General Assembly leaders on their plan to undermine the federal unemployment insurance extension, Rep. Price wrote:
"Now is not the time to abandon tens of thousands of North Carolinians who have lost their jobs through no fault of their own and who stand to benefit from federal policy if their state government does not stand in the way. Nor can our state, with an unemployment rate of 9.2 percent, afford to remove the projected $650 million in economic activity that would result from these benefits this year. I urge you to consider these grave consequences as you plot the course of House Bill 4."
The bipartisan American Taxpayer Relief Act of 2012, which passed with the support of 85 U.S. House Republicans and 89 Senators, extends the authorization for the federal Emergency Unemployment Compensation program through January 1, 2014. To remain eligible for federal assistance, states are not permitted to decrease the weekly benefit amount available through their own unemployment compensation programs, and the reductions contained in the Republican bill being fast-tracked in the General Assembly bill would violate this provision. Rep. Price said the proposed policy change puts state and federal policy on a "collision course."

Tar Heel Worker Campaign
Progress NC is reporting that a behind closed door deal concerning a plan to cut a deal on reforming NC Unemployment Insurance System is underway in the NCGA. The deal is being worked out between legislators and Chamber of Commerce with out any input form Worker Advocates (which mean the employee will get the short end of the stick). Length of time and amount of unemployment in on the chopping block.

Need medicine? It's up to your boss's religion
Republicans are trying to attach an amendment to the highway funding bill this week that could deny countless women and men access to all sorts of lifesaving healthcare, simply based on the stated beliefs of their employers.
The Right is claiming to stand up for the religious liberty of employers, but this attack is really meant to unravel healthcare reform from within. They want to give employers the power to impose their own religious beliefs on their employees, getting in between Americans and their doctors and taking life and death decisions away from the people who should be making them.
The vote in the Senate this week is just the start.
Republican leaders in both the Senate and the House have signaled that this is an election year fight they want to have, and they will be pushing for such utterly extreme legislation repeatedly.
Imagine your employer could deny you access to healthcare altogether on the grounds that their religion was opposed to modern medicine and they believed prayer was the best medicine. No exaggeration -- that's how far this amendment by Sen. Roy Blunt (R-MO) goes.
The Obama administration announced a reasonable accommodation on this issue, providing that in the Affordable Care Act mandate for contraception coverage, religiously affiliated institutions that object to contraception as a matter of religious doctrine did not have to pay for that coverage for their employees -- instead, insurance companies would cover the cost.
That compromise satisfied the majority of those critical of the mandate before it included that exemption, and has been widely hailed as striking the right balance between religious liberty and women's access to important healthcare.
The GOP and its Religious Right allies have not only moved the goal post with their new overreaching proposal, they have abandoned any pretense that their concern was ever really "religious liberty." This is about the Right's ongoing war on women's health ... about primarily male lawmakers and institutions making decisions for women about their bodies ... about giving employers undue power over their employees' lives ... about granting special privileges to the Religious Right that says the rules shouldn't apply to them ... and it's about trying to destroy healthcare reform.

NC Rep. Richard Burr, wants you to do community Service where Jobs were cut due to lack of funds, if you want to get your Unemployment check.
This week, I introduced a bill called the Unemployment Benefits Reform Act of 2012 which would individuals who have been unemployed for six months or more to complete 20 hours of public service and 20 hours of active job search or other work related activities per week as conditions for receipt of federal extended unemployment benefits. The United States economy is suffering, and we are experiencing record levels of sustained unemployment. Being unemployed for an extended length of time can be demoralizing for people looking for work, but engagement in volunteer service will encourage unemployed workers to maintain job skills, marketability, and a sense of self-worth while providing for the betterment of their communities. Even more, the active job search requirement will enhance the integrity of the unemployment system and its ability to identify and serve those most in need.
He want those on long term unemployment to work for free at the city and state parks, which had to cut jobs due to lack of funding. Work at your local nursing homes, libraries and other nonprofits, that cut staff due to lack of funds.. He want you to work for free while giving big business more tax breaks.. If you don’t work for free at these places you don’t get your check,which is the only life line for many..
Public service may be fulfilled by working for a 501( c ) (3) organization or a federal, state or local agency, and the bill protects government workers from displacement by only permitting volunteering with a governmental agency when permitted by current law.
Yes he wants you at one of these places, where budgets cuts force them to layoff workers. Now Burr, what to fill those vacancies with free labor, no benefits and I bet these companies will be getting huge tax breaks in return

Section 13(a)(17) of the Fair Labor Standards Act of 1938 (29 U.S.C. 213(a)(17)) is amended to read as follows:
‘(17) any employee working in a computer or information technology occupation (including, but not limited to, work related to computers, information systems, components, networks, software, hardware, databases, security, internet, intranet, or websites) as an analyst, programmer, engineer, designer, developer, administrator, or other similarly skilled worker, whose primary duty is--
‘(A) the application of systems, network or database analysis techniques and procedures, including consulting with users, to determine or modify hardware, software, network, database, or system functional specifications;
‘(B) the design, development, documentation, analysis, creation, testing, securing, configuration, integration, debugging, modification of computer or information technology, or enabling continuity of systems and applications;
‘(C) directing the work of individuals performing duties described in subparagraph (A) or (B), including training such individuals or leading teams performing such duties; or
‘(D) a combination of duties described in subparagraphs (A), (B), and (C), the performance of which requires the same level of skill;
who is compensated at an hourly rate of not less than $27.63 an hour or who is paid on a salary basis at a salary level as set forth by the Department of Labor in part 541 of title 29, Code of Federal Regulations. An employee described in this paragraph shall be considered an employee in a professional capacity pursuant to paragraph (1).’.

A BILL
To amend the Fair Labor Standards Act of 1938 to modify provisions relating to the exemption for computer systems analysts, computer programmers, software engineers, or other similarly skilled workers.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ‘Computer Professionals Update Act’ or the ‘CPU Act’.
SEC. 2. AMENDMENT TO THE FAIR LABOR STANDARDS ACT OF 1938.
Section 13(a)(17) of the Fair Labor Standards Act of 1938 (29 U.S.C. 213(a)(17)) is amended to read as follows:
‘(17) any employee working in a computer or information technology occupation (including, but not limited to, work related to computers, information systems, components, networks, software, hardware, databases, security, internet, intranet, or websites) as an analyst, programmer, engineer, designer, developer, administrator, or other similarly skilled
‘(A) the application of systems, network or database analysis techniques and procedures, including consulting with users, to determine or modify hardware, software, network, database, or system functional specifications;
‘(B) the design, development, documentation, analysis, creation, testing, securing, configuration, integration, debugging, modification of computer or information technology, or enabling continuity of systems and applications;
‘(C) directing the work of individuals performing duties described in subparagraph (A) or (B), including training such individuals or leading teams performing such duties; or
‘(D) a combination of duties described in subparagraphs (A), (B), and (C), the performance of which requires the same level of skill;

Pink Slip Truth Tour Stops In Greensboro

The tour stopped in Greensboro yesterday to show the public a pink slip (above) for every unemployed educator who lost a job this year because of K-12 education cuts in North Carolina.
The event is sponsored by Progress NC, a new and exciting organization that serves as a media voice for North Carolinians seeking to protect the qualities that made the Tarheel State great: a strong educational system, business competitiveness, forward-thinking government, thriving democracy, protection of natural resources and rich cultural traditions.
Progress NC Executive Director Gerrick Brenner and Research & Communications Director Justin Guillory are hosting the Pink Slip Truth Tour with a dramatic presentation that illustrates just how many teachers and teaching assistants have been laid off because of budget cuts to education. The tour is also designed to highlight the effects that overall education cuts have on North Carolina's families.
Brenner and Guillory are joined on the tour with veteran educator Tammie Veilleux of Washington County, who was laid off this summer because of the budget cuts. They are meeting with local media and educators along the way to emphasize the impact of budget cuts on classroom sizes, school resources and the preparedness of North Carolina's children for the future.

As you know, we released The House Republican Plan for America’s Job Creators earlier this year. While the debt crisis has demanded much of our attention, our new majority has passed over a dozen pro-growth measures to address the equally troubling jobs crisis, such as the Energy Tax Prevention Act and the Putting the Gulf of Mexico Back to Work Act. Aside from repeal of the 1099 reporting requirement in ObamaCare, however, each House Republican jobs bill now sits dormant in the Democrat-controlled Senate. When we return next week, the Joint Select Committee on Deficit Reduction will begin meeting to take an additional incremental step towards addressing our debt crisis. During this time, it is essential that the House continue our focus on the jobs crisis. Below are two areas of our jobs agenda that I want to bring to your attention for our upcoming fall and winter legislative schedule.
REPEAL OF JOB-DESTROYING REGULATIONS TO CREATE MIDDLE CLASS JOBS
Since passage of H.Res. 72 on February 11, our committee chairmen have been investigating and inventorying regulatory burdens to job creators. They’ve found many that have tied the hands of small business people and prevented job growth. By pursuing a steady repeal of job-destroying regulations, we can help lift the cloud of uncertainty hanging over small and large employers alike, empowering them to hire more workers.
Our regulatory relief agenda will include repeal of specific regulations, as well as fundamental and structural reform of the rule-making system through legislation like the REINS Act, the Regulatory Flexibility Improvements Act, and reform of the Administrative Procedures Act (all three bills are expected on the floor in late November and early December).
The following is a list of the 10 most harmful job-destroying regulations that our committee chairmen have identified, as well as a selective calendar for their repeal. These regulations are reflective of the types of costly bureaucratic handcuffs that Washington has imposed upon business people who want to create jobs.

Ellmers Slams Senate's Rejection of Cut, Cap and Balance
as North Carolina Unemployment Rate Rises to 9.9 %
WASHINGTON – Congresswoman Renee Ellmers released the following statement from her office in Washington this afternoon:
"Today we received another example of how dire our economic crisis is. This morning, the NC Employment Security Commission announced that North Carolina's unemployment rate has risen to 9.9 percent, even higher than the national average. These figures are deeply disheartening and show that our economic situation is not getting the full attention it deserves. People are struggling to make ends meet and worrying as to whether their business will be the next to hand out pink slips. Small businesses are seeing their budgets busted by high energy costs and uncertainty that currently exist in the market due to the threat of higher taxes, inflation, and government overreach. When will President Obama and Governor Purdue wake up and realize that their policies have failed and are only causing more harm to our economy?"
"Here in Washington, we successfully passed the Cut, Cap and Balance Act on Tuesday, which I was pleased to co-sponsor. The Cut, Cap and Balance Act is a constitutional, permanent solution to put an end to the spending-driven debt crisis and save our children and grandchildren from a bankrupt future. But this morning, the Senate rejected this important law, preferring instead to continue to put off our financial problems as they have for the past three years. This is not only irresponsible, but even more, it is hurting the American people. 'Where are the jobs?' is not a skewed question. After today's unemployment report, it continues to be a very real question."
This morning, the North Carolina Employment Security Commission released the latest unemployment figures, showing that North Carolina’s unemployment rate rose to 9.9 percent in June after holding steady at 9.7 percent the previous three months. Some 446,377 North Carolinians were unemployed last month, while total nonfarm employment stood at more than 4.05 million.

Pat McCrory's verbal attacks on the Governor

CHARLOTTE - NC Democratic Party Executive Director Jay Parmley issued the following statement in response to Pat McCrory's verbal attacks on the Governor in regard to new unemployment numbers.
"Pat McCrory's attack on the Governor is a shame and his solutions-- as far as we can intuit them-- are a sham. The former Mayor 
He hasn't even announced he's running for governor, which enables him to attack Bev Perdue without facing any scrutiny himself. That's cowardly and safe-- two things that Bev Perdue hasn't had the luxury to be since she defeated McCrory three years ago.
From McCrory, no solutions. He gave us a hint about his agenda last week when he issued a robocall urging supporters to demand that their legislators override Bev Perdue's vetoes. We can presume that he would have rubber stamped everything this republican legislative majority proposed.
This leaves voters triangulating McCrorys positions from one-sided press releases, speeches to tea party gatherings and the GOP agenda.
On the jobs issue, we can only assume that he would have permanently frozen long term unemployment benefits-- without relief-- as the leaders of his party attempted to do this year.
He would have allowed them to make even deeper cuts to our schools and the public sector, which represent the single greatest job losses government has direct control over. In this terrible economy, he would have laid off far more teachers than Thom Tillis and Phil Berger did this year already.
The unemployment rate would be even higher under Governor McCrory.
Meanwhile, the Berger/Tillis/McCrory formula for job creation is "reg reform, med mal and energy" (quoting an @SenatorBerger tweet in response to today's numbers). Not one of them has hung any details on that scant recipe for recovery.
Regulatory reform this session has taken the form of gutting environmental rules. Are we to assume that McCrory would entice manufacturers by advertising the most lenient pollution rules in the region?
Their Med Mal legislation sought to strip patients of their right to seek damages the event of an emergency room error. This creates job opportunities for whom? The lousiest doctors in the country, unemployable in states that care about consumer rights?
Finally, their energy plan seeks to open our pristine coasts and the piedmont to drilling and natural gas fracking. This would welcome Big Oil to the Tarheel State, creating a revenue stream for Republican politicians looking for political donations, and the potential for environmental disaster and polluted water for the rest of us.
Republican office holders and also-maybe-might-of-rans like Pat McCrory are pitching the same tired trickle down economics that most of us discounted years ago: tax breaks for millionaires, low wages for workers, zero regulations for polluters and big business.
It's a lie, and Pat McCrory is pushing it with impunity. If he'd like to announce he's running for office and stand before the people and the press to face our questions, he should do it. But the unfounded attacks that non-mayor, non-candidate McCrory has become so fond of don't do a thing to help bring down the unemployment rate. That's cowardice, pure and simple."
