NC NAACP Responds to Superior Court Upholding Unnecessary Redistricting Maps

Today, a three judge panel of Superior Court judges has upheld the harsh, oppressive, and racially divisive GOP drawn congressional district maps. The court explained that the maps "do not impair the constitutional rights of the citizens of North Carolina as those rights are defined by law." While the court does not disagree with the facts of this case they disagree with the application of the law. The North Carolina NAACP and our allies respectfully disagree. We contend that these maps were drawn unfairly and unnecessarily, and that the law is on our side. The NC NAACP is disappointed in the courts inability to accurately interpret applicable law. This ruling is a sanction on political re-segregation which we plan to challenge.

Justice is blind, deaf and stupid here in NC

The North Carolina Supreme Court sided Friday with legislative leaders who withheld emails and other documents between them and state-funded private attorneys about redistricting maps approved in 2011, ruling that those documents can be confidential. Rep. David Lewis, R-Harnett, who was chairman of the House Redistricting Committee when the maps were drawn, praised the ruling Friday. "It's very important for individuals to have the common-law right afforded to them of being able to have confidential communications with their attorneys," he said.

I bet if the Dem’s try this the GOP would be outraged..

NAACP Wins Again in Court:

Guilford County Commissioner Redistricting Plan Unconstitutional

(DURHAM) - For the second time in a week, the NAACP was victorious in defending the voting rights of North Carolinians. On Friday, the United States District Court of the Middle District of North Carolina agreed with the NAACP constitutional challenge to the newly imposed redistricting of the Guilford County Board of Commission by the North Carolina General Assembly when it enjoined the proposed changes from taking effect until the constitutional flaws are corrected. In this lawsuit, the NAACP successfully sought to protect the voting rights of over 40,000 Guilford county voters who would have been stripped of their right to be represented on the Guilford County Board of Commissioners.

Last year, the extremist leadership in the North Carolina General Assembly stealthily passed local bills in an effort to gain partisan advantage across the state. One of these bills, Session law 2011-407, bypassed the local democratic redistricting process and changed the method of electing the Guilford County Board of County Commissioners. In their mad rush to help local conservative politicians increase their political power, the General Assembly carved out flawed maps that the NAACP, and now the courts, found to be unconstitutional. By depriving some voters representation on the Board, this bill is a clear violation of the one person, one vote requirement under the equal protection clause of the 14th Amendment and Article 1, § 19 of the North Carolina Constitution. When Senate President Pro Tem Phil Berger was presented with the clearly flawed maps, he refused to correct them, instead saying he would not change them until forced to do so by the courts.

"Twice now the General Assembly leadership has chosen to waste taxpayer dollars in court proceedings instead of following the North Carolina Constitution that they are required to uphold," said Rev. Dr. William J. Barber, II, President of the NC NAACP. "We sit and watch in utter amazement that we have elected officials so uninterested in following our Constitution, whether it comes to voting rights, quality education for all or equal protection under the law. It is clear that the North Carolina NAACP and the progressive community must stay vigilant as we keep our eyes on Jones Street in the coming months."

The NC NAACP brought existence of these constitutional defects to the attention of leaders of the NC General Assembly and they refused to address them by contending that their actions were legal and in conformity with their legislative agenda. A timely correction of these violations would have prevented this lawsuit and the needless expenditure of State funds which is required to litigate voting rights cases.

In its order, the Court directed the State of North Carolina to show how the North Carolina General Assembly is going to correct the unconstitutional redistricting mandate in a timely manner in order to allow elections to go forward as originally scheduled. A hearing on the remedies will be held on February 22, 2012.    

The NAACP recognizes the importance of ensuring that all people are afforded the opportunity to participate equally and fairly in the electoral process.  The NAACP will continue to defend voting rights across the state.

NC NAACP Files Lawsuit Against Guilford County Commissioner Redistricting Plan

(DURHAM) - Today the North Carolina NAACP and Greensboro Branch NAACP, with the full backing of the NAACP's National Office, filed a lawsuit in Federal District Court against Speaker Thom Tillis, Senator Phil Berger and the Guilford County Board of Elections challenging a clear and heinous violation of the equal protection clauses of the United States and North Carolina. The lawsuit addresses the faulty legislation passed by the North Carolina General Assembly to redistrict the Guilford County Board of County Commissioners.

The conservative leadership in the North Carolina General Assembly used their newly obtained majority to stealthily pass local bills in an effort to gain partisan advantage across the state. One local bill the General Assembly passed, Session law 2011-407, changed the method of electing the Guilford County Board of County Commissioners. By depriving some voters of representation on the Board, this poorly written bill, is a clear violation of the one person, one vote requirement under the equal protection clause of the 14th Amendment and Article 1, § 19 of the North Carolina Constitution. When this error was brought to the attention of the General Assembly's leadership, they indicated they would not correct this violation unless ordered to do so by a court.

Session law 2011-407, reduces the number of commissioners from 11 to 9 effective December 1, 2012, provides that 8 commissioners be elected by district; 1 commissioner elected at-large; establishes a redistricting map for the 8 districts that is very different from the County's original districts, and prohibits the Board of Commissioners from altering their own structure as would otherwise be allowed under state law. The bill specifies dates the 9 commissioners can be elected to office but does not change incumbent terms.

The effect of this law, as interpreted by the local Board of Elections, and confirmed by an opinion letter by the state Attorney General's office is that, for the next two years, no commissioner will represent District 6 and Districts 3 and 7 will have two commissioners. This clearly presents a One Person, One Vote violation for every voter in District 6 who will have no representation, and for every voter in any district that does not have two representatives. 

This is another example of an out of control legislature using their power to strengthen their partisan advantage without considering the impact on voter representation. We have confidence the issue will be quickly addressed and corrected by the court.

Berger is just one power hunger republicans who think he can do just about anything he wishes. Berger and his corrupt minions in the NCGA, by their own actions have told the citizens of Guilford/Mecklenburg that they county commissioners don’t know how to do their jobs.

After Commissioners of Guilford County held public meeting and spend a great time redrawing their county line, Berger broke is word and decided that he knew better and at last minute had the house and Senate decide the lines for the Guilford/Mecklenburg Counties.

Yes the Legislature has the authority to create county districts, but have left the task to the local officials for years. Could this be payback for what the Democratic-legislature did back in 1991?

Berger and his associates clearly weren't interested in public opinion and made no effort to hear from residents of Guilford County. Berger did say he intervened because of reports -- from unnamed people -- that the Democratic-majority Board of Commissioners wasn't going to pass a fair plan.

So better to ram through an unfair Republican plan than risk seeing an unfair Democratic plan adopted. And the Republican plan is unfair. It's not only grossly gerrymandered, it includes a mischievous provision that effectively blocks Commissioners Paul Gibson and John Parks, both Democrats, from running for re-election in an at-large seat when their terms end next year. From December 2012 until December 2014, no at-large seat will exist under this new plan. The reason obviously is to eliminate a seat likely to be held by a Democrat.

Just  who was this unnamed person? If there was one in the first place! Berger is a Politician, which mean in essences he is Liar by trade.

The legislature took the additional and unusual step of prohibiting Guilford commissioners from proposing new districts, which they would have to submit to a referendum, prior to July 2017. Berger and his associates really intend for the people and elected leaders of Guilford County to have no say in this matter for the next six years. They don't want their double cross undone.

GOP REDISTRICTING PROCESS TRANSPARENT?  (Yeah, transparently bogus).

RALEIGH - North Carolina Democratic Party Chairman David Parker reacted to NCGOP Chairman Hayes attacks on the Democratic Party's alternative maps today:

"Republicans don't own the public redistricting hearings that were held" said Chairman Parker. "The Democratic maps reflect what Democratic Senators learned at those hearings.  

"Senator McKissick, who issued alternative maps today, sat next to Senator Rucho throughout the hearings.  The difference is that  McKissick appears to have been listening and his maps reflect the real communities they represent."

"Meanwhile, the GOP maps were drawn by a highly paid Republican consultant so secret that we only learned his name last week.  As a public employee, paid by taxpayers, why wasn't Tom Hoffler made available to the public or press?"

"The maps released today by Democratic Senators Stein and McKissick are more compact and politically competitive.   They are fair and legal.  The GOP maps look like splattered bugs on Bob Rucho's windshield.  They seem to have sought inspiration everywhere but the wishes of real voters."

RALEIGH - Democratic Party Chairman David Parker reacted to news that Republicans used taxpayer money to pay GOP consultant Tom Hofeller to draw the current redistricting maps.

"Taxpayer money is paying for a partisan republican bonanza.  Women are paying this man for the elimination of female incumbents.  African Americans are being forced to pay a republican consultant to cram 49% of them into three congressional districts. He's working against their interests, and they're footing the bill. They're paying for their own disenfranchisement."

Parker called for a full audit of Republican redistricting committee expenses.

"Absolute power corrupts absolutely and but for Bev Perdue's veto this session, the Republicans power would have been absolute.  Well, she can't veto these maps, and we're getting a taste of absolute Republican power."

Meet the Berger Corrupt-Family

No, it's not the Gerber Baby.  Meet the hand- picked Republican frontrunner for the newly drawn 13th Congressional district and the son of the most powerful Republican in the Senate:  The Berger Baby.

Phil Berger Jr may be 39 years old, but he is one lucky kid.  His Dad-- Senate President Pro Tempore Phil Berger Sr.-- not only had a big hand in purging Brad Miller’s district of registered Democrats and proposing it run from Surry to Wake County, but he'll be able to steer incredible GOP resources to his son's Congressional campaign when the announcement becomes official this fall. 

The GOP maps mean big opportunities for the children of gerrymandering in new majority Republican seats across the state.  How many more Berger Babies are there? 

Now I thought this was completely against the law, Talking about favoritism to the high level. Not to speak of the corruption that it breeds. If the Democrat did this every Republican would be crying foul and suing the hell of them..

I sincerely hope the NAACP does file a challenge to these new congressional maps..

NAACP Raises Major Challenges to Congressional Redistricting and Will Call for  Justice Department and Court Review if the Ultra-Conservative Leadership of the General Assembly Persists in Voting to Approve the Discriminatory Gerrymandering in the Current Redistricting Maps

 

I am Rev. Dr. William J Barber, State President of the North Carolina NAACP, member of National Board of the NAACP and I stand here representing 120+ units and thousands of members. As you may know, the NAACP was one of the major architects of the Voting Rights Act of 1965.

 

            It is with mixed feelings that I appear before this committee in order to present our response to the draft of the Congressional Redistricting map which this committee prepared. I understand that you already have the votes and commitments from your party's colleagues to enact this map. While some say politically this enactment is a done deal, there still may be a review done by the US Department of Justice and the Courts. Nevertheless, since we have been given an opportunity to place our opposition to this plan on the record, this we shall do.

 

            You have chosen to prepare a plan which is bold and bodacious in its attempt to stack and pack as many racial minorities in the same districts in an effort to gain a partisan political advantage for future years for the Republican Party. The plan presented by this committee violates every generally accepted and recognized redistricting principle as mandated by the United States Supreme Court in Shaw v. Reno, Shaw v. Hunt and Miller v. Johnson.

 

            In Miller v. Johnson, a case which discussed an effort by the Republican-controlled United States Department of Justice to create "Black Max" congressional districts, the United States Supreme Court condemned the unnatural and contrived "stacking  and packing" of African-American into separate voting districts in order to maximize the number of Republican congressional districts. That Court declared that an intent to establish a racial basis for the creation of a particular district can be proved by showing irregular and unnatural district shapes or by a review of the stated legislative purpose to segregate minority voters into particular districts.

 

            In presenting this claim, it can be established that the drawing of the particular lines which you have drawn defy and subordinate every traditional race-neutral district principle. Those principles include, but are not limited to, compactness, contiguity, respect for political subdivisions and/or communities of shared interests.  

 

            The map you have drawn subverts each of these redistricting principles to an illegal consideration of race. What is obvious in your plan is that African-Americans have been removed from many districts and packed into the proposed 1st, 4th and 12th. This packing and stacking was not required by the 1965 Voting Rights Act, but I guess that the courts will have to determine this issue. For example, the 12th district, which is represented by Congressman Mel Watt, has been packed with just about every African-American who lives around the I-85 corridor from Greensboro to Charlotte. The proposed African-American composition of that district has increased from 42% to over 50%. This increase in the African-American presence is due to the "bleaching out" of African-Americans from the surrounding congressional districts.

 

            Section 5 of the Voting Rights Act was adopted in 1965 to outlaw discriminatory voting practices that had been responsible for the widespread disenfranchisement of African Americans. In North Carolina, 40 of our 100 counties are covered by Section 5 of the Voting Rights Act due to past harms done to our minority population.

 

The Rucho-Lewis Congressional map disregards this long and painful history for five counties covered by Section 5 of the VRA. In drawing this map, Gates, Washington, Beaufort, Craven, and Wayne Counties were removed from the 1st Congressional District.

 

This district was developed intentionally to overcome years of disenfranchisement and voter exclusion. Removing these counties from District 1 dilutes the voting power of these Section 5 counties to elect the Congressperson of their choice. We have seen these tactics before. When radical and extreme politicians seek to consolidate their political power, we remember that it was from George White in 1900, after which racist extremists took over the NC General Assembly and disenfranchised African-Americans (a third of North Carolina's population at the time) until Eva Clayton in 1990, a total of 90 years, before African-Americans in North Carolina could elect a Congressperson of their choice. 

 

District 1, represented by Congressman G.K. Butterfield (Dem) lost population and must expand in order to comply with the one-person, one-vote requirement. This could have been accomplished by expanding the district as far as necessary to meet the population requirement. Instead, Rucho and Lewis removed five key counties covered by Section 5 of the VRA and extended this rural eastern district all the way into Wake County.

 

Drawing part of downtown Raleigh into a district composed primarily of rural Eastern North Carolina counties is inappropriate. Removing five Eastern counties that are traditional communities of shared interest is also inappropriate. The result is a dilution of the voting power and influence of the people of Gates, Washington, Beaufort, Craven and Wayne Counties. Exactly what the Voting Rights Act of 1965 intends to protect.

 

This map does not show concern for African American and minority political power or upholding civil rights. It is merely an instrument of partisan power to suppress and dilute the vote of minorities across the state. Adoption of this map takes our state backwards at a time we need to be moving forward.

 

            In North Carolina, African-Americans have repeatedly been the victims of racial gerrymandering in order to achieve some political advantage. Thus we understand what you are doing and I stand here today to say to you that we voice our objection and indignation. In the past, our influence in the election of congressional representatives has been muted. The General Assembly is engaged in this unseemly effort to segregate African-Americans and submerge our influence into two congressional districts. This is being done for the sole purpose of creating ten districts in which Republicans can elect its members. In so doing, this committee has totally abandoned any effort to adhere to sound and traditional districting principles and has thus perverted the redistricting process. Shame, Shame, Shame On You. This is regressive, this is wrong and we will see you in court.

The North Carolina State Conference invites you to participate in our upcoming Redistricting Conference co-sponsored by The Alliance for Black Elected Officials scheduled for Saturday, July 16 at the OIC Building in Rocky Mount, NC. 

The purpose is to invite area elected officials, local and state NAACP leadership, and community leaders who live and work in North Carolina's Section V counties (list attached) to discuss gerrymandering efforts spawned by the ultra-conservative, far right Tea Party Republicans on the national and state levels.  These attempts will have a retrogressive effect on voting rights and protections for the next decade and beyond, and we want to ensure that all North Carolinians' voting rights are protected and not diluted.  It is incumbent upon us to educate all elected officials, in particular those whose positions have been created by the protections of the United States Constitution through the 15th Amendment, and by Section V of the Voting Rights Act.

We are inviting Congressman G. K. Butterfield (D-NC 1st District), Congressman Mel Watt (D-NC 12th  District), State Senator Floyd McKissick, Jr., Chairman and members of the NC Legislative Black Caucus; Walter Rogers, President and members of the NC Black Leadership Caucus, and Brad Thompson, Executive Director and members of the NC Alliance of Black Elected Officials.

NAACP threatens suit over Congressional redistricting plan

The state president of the NAACP told lawmakers drawing up a map for North Carolina Congressional districts Thursday, "We will meet you in court."

Rev. William Barber called the map, developed by the Republican majority to re-allocate voters based on 2010 Census data, "regressive" and "shameful" in comments at a public hearing. 

I'm glad we have someone to help protect those whom need it the most in this state. Rev. Barder is a thorn in the sides of the GO because they know he is right 95% of time and has the power to get the people behind him..

Democratic speakers criticized the proposal as gerrymandering that would diminish the power of black voters. Barber and others say the plan violates the Federal Voting Rights Act by removing five counties – Gates, Washington, Beaufort, Craven and Wayne – from the 1st District, a seat currently held by Democrat G. K. Butterfield.

Well this was their plan when they redrew those lines.

Former GOP state Sen. Woody White of Wilmington praised lawmakers for a map he said would give southeastern voters the chance to elect a Republican for the first time in more than a century.
