The North Carolina NAACP and the Forward Together Moral Movement Applaud Court Decision to Rule Unconstitutional the NC Extremists' Attempt to End Teacher Tenure
DURHAM, NC - In a sweeping victory for North Carolina's teachers and its children, a Wake County judge ruled today that the extremist lawmakers' attempt to end teacher tenure in our state is unconstitutional and issued a permanent injunction against the law that would have given educators a raise in exchange for eliminating their tenure.
The North Carolina NAACP and the Forward Together Moral Movement welcome Judge Robert Hobgood's decision and remain confident that while extremism may flourish in this General Assembly, these morally indefensible laws will not stand when subjected to the strict constitutional scrutiny of our court system.
"Again and again, the courts are reminding the extremists in our General Assembly led by Speaker Thom Tillis that holding an ideological majority does not give you the right or the power to run roughshod over the constitutional protections guaranteed to our public education system and to our public school teachers," said Rev. Dr. William J. Barber, II, president of the North Carolina NAACP and architect of the Forward Together Moral Movement. "The courts moved towards achieving justice in public education 60 years ago in its Brown v. Board of Education decision. The courts are moving towards justice here in North Carolina again 60 years later."
On Monday, May 19, the NC NAACP, the Forward Together Moral Movement, its HKonJ coalition partners and North Carolinians fed up with these extremist policies will join together at Moral Monday in Raleigh to push for pay raises for our teachers that do not require them to give up their tenure and the employment protections that come along with it.

Draft Proposal Would Exclude a Third of At-Risk Children from NC Pre-K Eligibility
Gov. Bev Perdue today called on leaders in the North Carolina House to abandon an effort to deny access for tens of thousands of children to quality early childhood education programs.
On Wednesday—the same day Gov. Perdue announced 2,000 new slots across the state for at-risk 4-year-olds in the state’s nationally recognized NC Pre-K program—a draft report by a House select committee surfaced that would deny access for tens of thousands of 4-year-olds currently eligible for NC Pre-K.
"A mountain of research confirms that dollars invested in early childhood education pay enormous dividends," Gov. Perdue said. "We should be working to provide more access to at-risk 4-year-olds, not looking for ways to exclude the children of working families from this valuable program."
Under current guidelines, a child from a family of four with an income of $50,975 is eligible for NC Pre-K. Under the draft recommendations by the House Select Committee on Early Childhood Education Improvement, that threshold would be lowered to $22,350.
Gov. Perdue has advocated expanding early childhood education as the General Assembly’s budget has cut funding and reduced the number of slots available. In July, Superior Court Judge Howard Manning issued an order in which he said that “[t]he State of North Carolina shall not deny any eligible at-risk four year old admission to the North Carolina Pre-Kindergarten Program.” The Judge also directed the state to “provide the quality services of the NCPK to any eligible four year old that applies.”
The House’s draft recommendations would alter the definition of "at risk" to exclude approximately a third of the current eligible population from NC Pre-K.

Perdue: 3/4 sales tax Proposal
Gov Perdue would like to bring back the penny sales tax (well3/4 of a penny.)
This tax will to improve our Education system here is NC. Which this would not be problem if the GOP gang in NCGA left this tax in place. I don’t have a problem with this tax.

If Tillis and his stupid pretty so-called grown men keep attacking education like they are doing now, that number will continue to drop, till one day the Federal gov’t steps in and takes over NC’s Education system.. Do we really want that. Its bad enough that we 49th in education..
Tillis need to get a grip and open his eyes, he is not protecting the kids of NC, he is in face destroying their lives before they can even have one.

The Chester Upland School District in Delaware County, Pennsylvania suffered a serious setback when Gov. Tom Corbett (R) slashed $900 million in education funds from the state budget. The cuts landed hardest on poorer districts, and Chester Upland, which predominantly serves African-American children and relies on state aid for nearly 70 percent of its funding, expects to fall short this school year by $19 million.
The teachers have agree that many would still work as long as they could.. why not getting paid..
The Governor decided it was more important to protect the special interest groups tax breaks instead of providing an education for the poorest kids in PA.. It would seem that Big Oil and Gas and Tobacco has PA Governor in their pockets..
Teachers going with out pay.. While here in NC Tillis claim they only teach for the money.. and they don’t care about the kids.. Gov. Tom Corbett is a fucking crook who should be arrest for placing the welfare of the gas, oil and tobacco companies above the education of PA children.

Corbett became governor on January 18, 2011. One of his first actions was the proposal of a new state budget that would decrease spending by 3%. The proposed budget received significant criticism due to its cuts in state-supported higher education by 50%. Under the new budget, funding granted to the 14 universities of the Pennsylvania State System of Higher Education and state-related universities Penn State, Pittsburgh, Temple, and Lincoln would be cut in half, totaling $625 million. Corbett has said, however, that he will not attempt to limit collective bargaining, as have Republican Governors John Kasich of Ohio and Scott Walker of Wisconsin.[15]
Natural gas
As governor, Corbett maintains that Pennsylvania should not tax the natural gas industry.[16][17] In February 2011, Corbett repealed a four month old policy regulating natural gas drilling in park land, deeming it "unnecessary and redundant" according to a spokesperson. The Pennsylvania Democratic Party called the repeal a "payoff" to oil and gas interests which donated a million dollars to Corbett's campaign.[18] According to Corbett, "had they not given me a dime, I would still be in this position, saying we need to grow jobs in Pennsylvania.".[19]
I can only hope that our Teachers would do the same if Tillis and his crooks did what Corbett did.. Just to prove to Tillis that they aren't solely in it for the money..

The NC Association of Educators won a small victory by getting a Judge to order a temporary restraining order, putting the mid-nite override bill on hold.
This vote will be the undoing of the NCGA GOP. Tillis is face a backlash over this vote, where is claims that they had the right to do.. But we all know if the was reverse they would be doing the complaining and whining about it. That the Dem’s over step their power and so on.. Its ok when they do, not when the other side does..
I can only hope that this will wake up NC citizens, so they can see what the GOP is doing to our state before it too late..

What the Hell is Phil Berger Problem: beside not having a Brain!
Recently the Governor Perdue call on the out of touch members of the Legislature to comply with the most recent court order, concerning the “more at Four” Program.. However Berger-head reply that he wasn’t interested in funding the program, and they are seeking to over turn the court order.
The NCDP (NC Democratic Party), Chairman David Parker say it the best..
“Phil Berger needs to stop picking on four-year-old children
and do his job,” said North Carolina Democratic Party Chairman David Parker. “Instead of working with the Governor to put over 6,000 kids back in the classroom, Senator Phil Berger is playing politics with our children’s futures—his priorities are clearly out of whack.”
Why is Berger picking on these at risk kids.. O’ don’t worry Berger-Head is also opposed to the Governor’s proposal to stimulate the NC economy, he recently block the Governor’s efforts to bring in New Jobs to our state as well..
We need to get Berger and his sick, backward ideology out of the Legislature.

The tour stopped in Greensboro yesterday to show the public a pink slip (above) for every unemployed educator who lost a job this year because of K-12 education cuts in North Carolina.
The event is sponsored by Progress NC, a new and exciting organization that serves as a media voice for North Carolinians seeking to protect the qualities that made the Tarheel State great: a strong educational system, business competitiveness, forward-thinking government, thriving democracy, protection of natural resources and rich cultural traditions.
Progress NC Executive Director Gerrick Brenner and Research & Communications Director Justin Guillory are hosting the Pink Slip Truth Tour with a dramatic presentation that illustrates just how many teachers and teaching assistants have been laid off because of budget cuts to education. The tour is also designed to highlight the effects that overall education cuts have on North Carolina's families.
Brenner and Guillory are joined on the tour with veteran educator Tammie Veilleux of Washington County, who was laid off this summer because of the budget cuts. They are meeting with local media and educators along the way to emphasize the impact of budget cuts on classroom sizes, school resources and the preparedness of North Carolina's children for the future.

Email from NC Democratic - Tillis, McCrory and Berger: Turning Back The Clock On NC Schools
Last week, Republicans in the North Carolina General Assembly decided to challenge a court ruling on pre-kindergarten access could lead to an appeal of the landmark Leandro school-quality case.
A recent court ruling overturned the Republican's attempt to charge the parents of at-risk children a premium fee to send their 4 year olds to pre-K programs offered by public schools. Now, in GOP challenge to that ruling, Senate Republican leader Phil Berger's chief of staff said in a memo to Senate Republicans that, by appealing the ruling, the GOP’s ultimate goal of overturning the Leandro case could be a possible benefit of such action.
Governor Perdue acted swiftly in response to the court ruling by issuing an executive order restoring the high standards and accessibility of the ‘More at Four’ program for all at-risk children. Sen. Berger's Chief of Staff's reaction was to personally insult the Governor by suggesting that she is a 2-year old who needs to attend day care. Shameful.
Republicans clearly believe that slashing schools budgets, eliminating pre-k programs for as-risk children and decimating our public colleges and universities are all things to laugh about—Democrats don't think there is anything funny about this destructive agenda.
This effort by the GOP is nothing more than a Trojan horse designed to turn back the clock on decades of progress and excellence in North Carolina’s public education system. I have no doubt that the ultimate goal for the Republicans is to overturn the Leandro case, de-fund our schools and completely dismantle public education in North Carolina.
The Leandro case is the legal foundation that provides for a sound basic education for every public school student in North Carolina. By attempting to overturn the case, Republicans in the General Assembly are attempting to return to an era of extreme inequality in public education.
You don’t have to look far to find journalists, citizens and experts from all across the state who not only support the ‘More at Four’ program; they also oppose overturning the Leandro case. It’s destructive, it’s immoral and it’s against everything that we stand for in North Carolina.
It has become painfully clear that Tillis, McCrory, Berger and their allies in the General Assembly are out of control and must be stopped—Speaker Thom Tillis was even quoted recently as saying that he will "do whatever the hell he wants".
A simple penny would have would have prevented the Tillis, McCrory and Berger team cuts to pre-K programs like More at Four, and would have protected teacher and teaching assistant positions in the classroom. Make no mistake about it, the Republicans are dead-set on turning the clock back on North Carolina—unfortunately for them, Democrats will simply not let it happen.

(RALEIGH) -- North Carolina school districts could soon get a break from the stringent testing mandates in the No Child Left Behind law, as long as they pursue other reform efforts.
Superintendent of Public Instruction June Atkinson said she’ll pursue an exemption from some reporting requirements. However, the proposal must first get approval from the State Board of Education.
“We want to have our schools measured by ABC accountability model rather than the all or nothing that is a flawed system of No Child Left Behind,” Atkinson said in an interview.
Critics argued that schools have been unfairly punished by the law, which required all students to be proficient in math and reading by the end of the 2013-14 school year. Schools that fail to meet those performance goals could lose federal funding. President Obama recently authorized federal education officials to grant the waivers because Congress failed to address those concerns and rewrite the widely criticized law.

MARCH AGAINST ACADEMIC GENOCIDE

The NAACP and its Partners in the Local Peoples Assembly are "Marching Against Academic Genocide" this Saturday morning at 9 o'clock at Marshall Park. The words "Academic Genocide" were N.C. Superior Court Judge Howard Manning's powerful accusation about the relentless resegregation and ghettoization of Greater Charlotte's schools in the past dozen years. Judge Manning has been charged by the N.C. Supreme Court to enforce the requirement in the North Carolina Constitution that the State must provide every child with a sound basic education.
Local NAACP members and other people of conscience have watched in disgust and alarm, as Charlotte Mecklenburg school leaders have moved further away from the Global Communities of Inclusivity that their predecessors had tried to create to implement the U.S. Supreme Court's mandate to de-segregate in 1970. "It is a shame," one leader said, "that the only time we can come together as a community is when the Courts order us to."
But in the past several years, Charlotte Mecklenburg school leaders have restored segregated schools. They have packed high-poverty, low-income students and families into racially-identifiable schools that are clearly unconstitutional. Their policies cast out, cast down and cast away more students than they educate. The resegregated schools destroy the lives and spirits of teachers and other educators. They have turned our schools into a corporate assembly lines, rather than producing individual geniuses ready to make our increasingly diverse society a better place.
Rev. Dr. William J. Barber, NC NAACP President, who has helped lead the fight in Wake County against the same forces who have restored segregation here, commented: "The racial and class disparities created by Charlotte Mecklenburg's resegregated schools not only destroy many of our students; they also help destroy our minority neighborhoods. Earlier this year, Supt. Gorman announced he was closing 11 predominantly minority schools in District 2 and 3, under the pretext they were under-capacity and it would save money by shutting them down." If race were removed from the analysis, then the most logical thing to do would be to transport some suburban students from over-crowded schools to the under-used inner city schools. Make the inner city schools educational and community centers for diverse communities that could be developed around excellent inner city schools.
The Charlotte NAACP and its local partners in social justice and civil rights invites all parents, teachers, sororities, fraternities, churches and those who love justice and equality for our children, to join us Saturday, August 13, 2011. Put the national spotlight on Charlotte's resegregated system. The schools reflect the racism in our larger community.
Rev.
