DURHAM - The North Carolina State Conference of the NAACP is releasing a letter petitioning Governor Beverly Perdue to pardon the Wilmington 10.  The NC NAACP joined members of the Wilmington 10 and their attorneys for a news conference at the State Capitol on Thursday morning.

RE:  Petition to Pardon the Wilmington Ten

Dear Governor Perdue:

In September 1972 ten young North Carolinians were tried and convicted of major felonies in New Hanover County.  After the dust settled, it turned out their main crime was trying to obey the Law, namely the requirements of the U.S. Constitution and the U.S. Supreme Court to dismantle the separate and unequal school systems of New Hanover County.  The young people were called the Wilmington Ten:  Ben Chavis, Wayne Moore, Marvin Patrick, Connie Tindall, James McKoy, Willie Vereen, Reginald Epps, Anne Shepard-Turner, William "Joe" Wright, and Jerry Jacobs.

In 1980, after many had served 8 years in prison, the U.S. Court of Appeals ruled they had been victims of outrageous acts of prosecutorial misconduct. Chavez v. State of North Carolina, 637 F.2d 213.  In language that has become too familiar to those of us who believe in racial justice in North Carolina, the Appeals Court found: "The prosecution's failure to produce . . . to defense counsel the 'amended' statement and the record of the hospitalization of the state's key witness and the restrictions upon cross-examination of the key witness and another about favorable treatment which might have induced favorable testimony require us to overturn the convictions."

Such gross prosecutorial misconduct is often associated with the trials of poor minorities and civil rights activists.  Each time this linkage is validated by higher courts, it widens the breach in our human family. . . it aggravates the hurts of past indignities.  Our system does not empower our courts to repair and heal such breaches and wounds.  Our constitution, instead, places such acts of human compassion in your hands. 

Therefore, on behalf of the North Carolina Conference of 125 adult, college and youth NAACP Branches across the state, I ask you to pardon the Wilmington Ten.  "And you shall be called, the repairer of the breach, the restorer of paths to dwell in." Isaiah 58:12.

Eads, diagnosed with ovarian cancer, was turned down for treatment by two dozen doctors out of fear that treating a transsexual person would damage their reputations. By the time Eads received treatment, the cancer was too far advanced to save his life. During his final year, Robert fell in love with male-to-female transsexual, Lola Cola. Southern Comfort also highlights the discrimination many transgender people encounter when seeking healthcare.

Bristol P, on Obama Parenting

While Bristol is running around Alaska screwing every Tom, Dick and Harry, she has found the time to talk about Obama role as a father, and if he is doing a great job or not.

In this case, it would’ve been helpful for him to explain to Malia and Sasha that while her friends parents are no doubt lovely people, that’s not a reason to change thousands of years of thinking about marriage. Charlotte might be the first to lose it Domestic Partner Benefits

James is already pushing Mecklenburg to scrap its policy that provides domestic partner health insurance benefits to employees in same-sex relationships. The county has been offering same-sex benefits to employees since commissioners approved the policy in 2009.
James fired off the following email to County Manager Harry Jones and county legal staff early Wednesday morning:
Since Amendment One has passed when will we get a memo or something that outlines what changes we need to make to our health plan to be in compliance? I recall when the Democrats on the Commission forced the issue and added these benefits for homosexuals that a number of legal experts said it was illegal then – including the City attorney. Now that Amendment one has passed it obviously is illegal to offer this benefit as there is now only one ‘domestic legal union’ recognized in the state.
Prior to the vote most scholars (left and right) said that Amendment One would eliminate local faux ‘marriage’ benefits for homosexual employees. I would cite them but you know them all too well.
Still, I would like to know when the Board can expect information on the changes Amendment One wrought (or are we going to break the law and spend scarce resources on litigation we will likely loose)?

The statement from Protect All NC Families

Statement from Jeremy Kennedy:

Tonight’s results were disappointing, not just for gay and lesbian North Carolinians, but for the hundreds of thousands of non-traditional families who may face the harmful impact of Amendment One. Our campaign may have fallen short this evening, but your work over the past several months did not. Your efforts and dedications achieved many victories along the way, and demonstrated to North Carolina and to the entire country that discrimination and victimization will not achieve easy victories.

Tonight’s result was truly historic. This amendment began with a forty-point lead just a few months ago – but you, undeterred and undaunted, worked to educate your fellow citizens about its harms. Your work has made a difference not just in North Carolina but in our country as a whole. People from all over the country can now look to North Carolina as an example of a state that fights to protect, defend, and support all of its citizens.

Our campaign was a rejection of the divisive vision offered by the National Organization for Marriage and similar organizations who advocated for this damaging amendment. Just as they have done in many other states, these organizations injected millions of dollars of funding into a messaging campaign that framed the Amendment as a fight to protect “family,” never admitting that it stood to endanger families, children, and individuals across our state.

Over the course of the campaign we showed them that North Carolina was better than this amendment, and better than their divisive tactics and misleading messages. We may lost in the polls tonight, but in the final days of this campaign we succeeded in reframing this debate, replacing divisive messaging and scare tactics with pragmatic discussion and empathy.

We would like to thank you and everyone who fought against Amendment One. Over the course of the campaign we were inspired by the tens of thousands of people we met at events, encouraged by the thousands of volunteers who stepped up and spoke out, and awed by the 11,000 people who contributed financially to our success.

All of our efforts were boosted by a historic coalition that came together across North Carolina, and our spirits were lifted by our diverse and courageous allies. Our partners include Equality North Carolina, HRC, the NC NAACP, ALCU-NC, Blueprint NC, Replacements, Ltd., Southerners on New Ground, and dozens of faith communities and community organizations.’

Together, we have proven to North Carolina and the entire country that fear tactics, discrimination, and division may compete with love, compassion, and solidarity in the short term, but we know that the time is coming for true equality. As Martin Luther King, Jr. said, “the arc of the moral universe Is long, but it bends toward justice”

Finally, I want to say to all North Carolinians, gay and straight, who I have met during this campaign: you are worthy of love and acceptance. Your family cannot be defined by discriminatory amendments or statutes. I ask that we continue to support one another, fight for one another, and work together to move this state and our society closer to our ideals -closer to our creed that ALL men and women are created equal.

Thank you for your support over the course of this journey and I urge you to please continue to work with all of our coalition partners on behalf of equality in North Carolina and beyond.

The Day After NC's Vote on Amendment 1 in Wilson NC

the Campaign For Southern Equality:

On May 8th, North Carolinians will decide on a proposed amendment to the state constitution that would ban marriage, civil unions and domestic partnerships for same-sex couples. Beginning the next morning, the WE DO Campaign will visit eight counties where more than forty LGBT couples will apply for marriage licenses in their local communities, with clergy, elected officials, family, and community members accompanying them in support. The couples will be denied licenses because they do not meet the legal requirements for marriage in North Carolina, which stipulate that partners must be of the opposite sex. In each community, the WE DO event will also include a Prayer Service for Reconciliation led by clergy. In select counties, couples and allies will conduct a sit-in at the Register of Deeds Office after the denials occur, as a peaceful act of civil disobedience.

NC NAACP Joins Triad Clergy for Rally Against Discrimination in the Constitution Two Days Before Election Day

GREENSBORO - North Carolina clergy from across the State and leadership from the North Carolina State Conference of the NAACP will gather in Greensboro on Sunday, May 6, 2012 for a Prayer Meeting and Rally against Discrimination in our Constitution.

            The rally will begin at 4:30 pm at Mt. Zion Baptist Church, 1301 Alamance Church Road, Greensboro, NC. A news conference will precede the rally at 4:00 pm.

            Rev. Dr. William J. Barber, II, President of the North Carolina State Conference of the NAACP will join the Ministers Conference of Winston-Salem and Vicinity, the Pulpit Forum of Greensboro and Vicinity, and the Greater Hickory Ministerial Alliance for the rally. The Ministers Conference of Winston-Salem and Vicinity will also officially release their position statement encouraging North Carolinians to vote AGAINST Amendment One.

Tami Fitzgerald, bring a bunch of lawyer together to say that if Amendment 1 passing it won’t impact NC Domestic laws.

Jeff Hunt, a District Attorney from Henderson, Polk, and Transylvania Counties said, "I urge the public to take a look at this. Do not fall for false analyses. I am amazed that these claims are even being made by lawyers, but I can assure you that the Amendment does not weaken our protections of children. It does not weaken the 50b and 50c protections. It does not weaken domestic violence protections in any way."
