Some lawmakers think Judge Howard Manning is just meddling by holding a June 22 hearing on whether the state legislature's proposed education cuts violate the constitutional rights of N.C. children. Noted Republican Senate leader Phil Berger: "I have something of a problem with judges assuming or attempting to assume the role of legislators."
Judges shouldn't put themselves in the role of legislators. But Manning is right to force lawmakers to defend the cuts they're proposing. The legislature's plans gouge preschool and other programs and would mean huge teacher layoffs. The proposals threaten the quality of education each child attending public school will receive. Manning notes aptly in his order: "The financial crisis notwithstanding, the basic educational assets guaranteed to each and every child in the North Carolina Public Schools must remain... "
This should be very interesting to see the Judge will rule, and the lies the GOP will tell.
